So... theoretically, you're at home with your pre-teen child, and you put in a dvd to watch, but "OOPS" wrong dvd, that was the one with the vid you shot of you & the wifey "gittin' jiggy wid it". Honest mistake. You stop the dvd as soon as you realize that you've made a mistake. Should your children be taken away from you anyway? Afterall "intent has no bearing on the distribution of porn to minors", right?
where do I begin...
a> I'm not distributing it to a classroom full of 11 year olds - in fact, in my home, popping it into the dvd player is not distribution.
b> If I were an at-home daycare and they were at my house, I believe I should have my license under review...so the answer is yes. If it were my kid at a daycare I'd take them elsewhere. I'd expect parents of kids I were looking after to do the same. (still a 'yes')
c> I would view this along the same lines of a pervert outside my kid's school handing out porn CDs of him boffing his playmate. go ahead and disagree. it's like saying "I didn't mean to pull the trigger so I don't deserve to be punished." and because it's a female teacher lets add "plus I look cute and innocent so I should be forgiven"
on a side note, I may have been more appreciative in my single days, pre-fatherhood.
