I'm no lawyer either but I don't believe that it really works that way. I believe that if a name has not been formally trademarked then despite its current and previous use it is fair game. I believe this was the case with West Point. West Point, NY is a town where the West Point Military Academy is located. West Point has been a town for a long time. Not too long ago I believe that the military academy (on the QT) actually trademarked the name much to the chagrin of town residents and business owners who owned businesses with West Point as part of their name. Businesses with West Point as part of their name would need permission and possibly have to pay royalty fees to the Academy for its use. Martha Stewart tried to do the same thing when she sought to trademark for a home furnishings line of products the name Katonah which is a village in NY where she currently lives. Word got out early and business owners and residents were able by getting national media coverage and some high powered pro bono legal help to change Martha's mind.

Is the forum still going to be attahed to Devere's domain? His main site was always used for promoting his art work so if we are still going to be attached to that Dave should pick something that fits with his art. Unless we are going to have our individual domain name I am not sure Dave would want to use something we come up with here for his art site.
