Michael, you don't lose your First Amendment rights. There are limits to indirect and direct lobbying that the organization can do. The speech of members of the forum will not be impacted. If RSF formally asked its members to contact a legislator on a specific actionable law or pending that, then that would be subject to restrictions but not forbidden.

The application process for a 501c3 is slow. You need to incorporate with the state first.

Fong and others, let me know if you need any advice while going through the incorporation process. I might even have an old version of the NOLO Press nonprofit incorporation book lying around here somewhere as well as sample articles of incorporation and by laws.

You don't lose your rights, they just become restricted according to IRS or other variable govt policy?

My concern is that the new "fairness doctrine" for the Internet might be used for discussion forums in the future the way that church members with 501(c)(3) have been told not to discuss political issues amongst themselves.

I have no idea about that stuff, but our forum has always tried to take a politically neutral tone for official policy. I don't think it should affect free speech for the members. hell, look at NPO's like the ACLU. THey're not at all neutral.

It's selective enforcement. Lots of things are going on now to restrict free speech on the Internet. Just wanted you all to be informed of the cons of 501c3.

I am pretty sure RSF would be pretty far down the line on the selective enforcement priority list. ;)

I agree, but dude, 600K people losing their jobs every month are likely to be hired by Big Brother for the Thought Police. Might sound weird depending on your intake of current events, but from my perspective, it's accelerating and more and more reports are coming in every day.

Never saw the TV show, but the wiki entry sounds very familiar to some of what's going on.
